Copyright & DMCA Policy

AP Practice Exam Online respects intellectual property rights and expects users to do the same. This Copyright & DMCA Policy explains how to report alleged copyright infringement on our AP and SAT practice platform, how we respond, and how users may submit counter-notifications.

This Policy supplements our Terms of Service, particularly sections on User Content, Source Attestation, Moderation, and Repeat Infringers. For privacy-related processing of notices, see our Privacy Policy.

Overview

Users may upload PDF exam materials for personal practice and, with consent and moderator approval, publish practice exams for others. Uploads must comply with copyright law. Users must not upload official College Board, ACT, ETS, or other protected materials they are not authorized to share.

We respond to valid copyright complaints, remove or disable access to infringing material when appropriate, and maintain a repeat infringer policy consistent with the U.S. Digital Millennium Copyright Act (DMCA) and applicable international law.

Designated Copyright Agent

Pursuant to 17 U.S.C. § 512(c), our designated agent for DMCA notices is:

Only copyright infringement notices and counter-notifications should be sent to copyright@apracticexamonline.com. Misdirected mail may delay processing.

What We Host

The Service may host or display:

  • Private uploads visible only to the uploading user;
  • Extracted question content derived from uploads through automated processing;
  • Published exams approved by moderators and shown to other users with source attribution; and
  • User-generated metadata such as titles, source declarations, and URLs.

We act as a service provider hosting content at the direction of users. We do not pre-screen all uploads but may review content submitted for publication or reported as infringing.

Reporting Copyright Infringement (DMCA Notice)

If you believe content on the Service infringes your copyright, please send a DMCA takedown notice to our designated agent. To be effective under U.S. law, your notice must include all of the following (17 U.S.C. § 512(c)(3)):

  1. Physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  2. Identification of the copyrighted work claimed to have been infringed, or if multiple works, a representative list;
  3. Identification of the infringing material and information reasonably sufficient to permit us to locate it (e.g., exam title, upload ID, public URL, uploader username, screenshots);
  4. Your contact information — address, telephone number, and email address;
  5. A statement that you have a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law; and
  6. A statement that the information in the notice is accurate, and under penalty of perjury, that you are authorized to act on behalf of the copyright owner.

Example subject line: DMCA Takedown Notice — [Work Title]

We may forward your notice to the affected user and may publish redacted summaries where permitted by law.

Notice Tips

  • Include direct links to infringing content on AP Practice Exam Online where possible;
  • Distinguish between private and published content—published URLs are easiest to action quickly;
  • If you are reporting on behalf of a publisher, state your authority and relationship to the rights holder;
  • Do not send notices for trademark disputes, privacy complaints, or general moderation issues to the DMCA agent—use info@apracticexamonline.com for other concerns.

Our Response to Notices

Upon receipt of a valid DMCA notice, we will:

  1. Review the notice for completeness and apparent good faith;
  2. Remove or disable access to the identified material where appropriate;
  3. Notify the uploading user of the takedown and the counter-notification procedure, when applicable;
  4. Document the action for repeat infringer tracking; and
  5. Restore material following a valid counter-notification unless the complainant seeks a court order, as described below.

We aim to process complete notices promptly, typically within several business days. Complex or incomplete notices may require follow-up.

We may remove content proactively if we independently determine it violates our Terms of Service or this Policy, even without a formal DMCA notice.

Counter-Notification

If you believe your content was removed or disabled by mistake or misidentification, you may submit a DMCA counter-notification to copyright@apracticexamonline.com.

Your counter-notification must include (17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and its location before removal;
  3. A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address, and telephone number;
  5. A statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which your address is located (or, if outside the U.S., any district in which AP Practice Exam Online may be found), and that you will accept service of process from the person who submitted the original DMCA notice or their agent; and
  6. Sufficient detail for us to contact you and restore the correct content.

If we receive a valid counter-notification, we will forward it to the original complainant. Unless the complainant notifies us within 10–14 business days that they have filed a court action seeking to restrain infringement, we may restore the removed material.

Warning: Knowingly submitting a false counter-notification may expose you to legal liability.

Repeat Infringer Policy

In accordance with the DMCA and our Terms of Service, we maintain a policy to terminate, in appropriate circumstances, users who are repeat infringers.

We may consider, among other factors:

Enforcement actions may include warning, temporary suspension, permanent Account termination, prohibition from publishing, and blocking re-registration. We are not obligated to follow a fixed strike count; we exercise reasonable discretion.

Rights holders may report patterns of abuse to copyright@apracticexamonline.com.

False or Bad-Faith Claims

Submitting false infringement notices or counter-notifications may violate 17 U.S.C. § 512(f) or similar laws and may result in liability for damages, including costs and attorneys' fees.

We may reject notices that:

  • Lack required elements;
  • Clearly misidentify non-infringing fair use or licensed user content;
  • Are sent for harassment, censorship, or anti-competitive purposes; or
  • Do not relate to copyright (e.g., pure trademark or defamation claims without copyright basis).

We reserve the right to seek reimbursement or legal remedies for abuse of this process where permitted.

Moderation Role and User Responsibilities

Moderators review some submissions before public publication but do not guarantee that all content is non-infringing. Publication approval indicates compliance with our platform rules at the time of review, not a legal opinion on copyright status.

Users are responsible for:

  • Uploading only materials they have the right to use for personal study;
  • Completing accurate Source Attestations;
  • Not uploading official unreleased exam content; and
  • Respecting takedown decisions and repeat infringer enforcement.

Source attribution displayed on published exams (e.g., "Questions adapted from [source]") reflects user declarations and does not imply our endorsement or a license from the rights holder.

Non-U.S. Rights Holders

If you are outside the United States, you may still send infringement complaints to copyright@apracticexamonline.com. Include:

  • Proof of ownership or exclusive license;
  • Specific URLs or identifiers on our Service;
  • Legal basis under your jurisdiction (if applicable); and
  • Good faith statement that use is unauthorized.

We evaluate non-U.S. notices under applicable law and our Terms. EU/UK rights holders may also reference national implementation of the EU Copyright Directive and platform liability frameworks where relevant.

We may update this Copyright & DMCA Policy from time to time. Changes will be posted with an updated "Last updated" date and version. Continued use of the Service after changes constitutes acceptance of the revised Policy for new submissions.

Material changes to takedown procedures will be reflected on this page.
